Section 108
Able to manage internally
(1) Each establishment may make regulations as needed for its internal management.
(2) When the establishment makes regulations related to services, conditions and facilities for the workers or when the authority authorized to give approval to the regulations made by the establishment gives approval to such regulations, it shall be done in a manner that does not conflict with the minimum standards and collective agreement mentioned in this Act.
(3) For the purpose of sub-section (1), the Ministry may make model regulations as required. But for banks and financial institutions, in the case of Nepal Rastra Bank and other institutions, it is not considered that the regulatory body has hindered the making of regulations.
(4) A copy of the regulations made by the establishment shall be registered in the office and such regulations shall be made available to the workers if they wish to see them.
(5) When making or revising the regulations, the establishment shall consult with such trade union if there is an official trade union in the establishment and if there is no such trade union with the active trade union.
(6) If any provision of the regulations made by the establishment is in conflict with this Act, prevailing law or collective agreement, the court may cancel such provision of the regulations or give other appropriate orders.
